These Terms of Service (“Terms”) govern your access to and use of matchy.bg, including all content, products, features, tools, and services available through the website.

The website is operated by Matchy LTD, registered in Bulgaria under company number 208750422, with registered address at Tvardishki Prohod 19, Sofia, Bulgaria.

By accessing our website or placing an order, you agree to these Terms, our Privacy Policy, and any other policies referenced on the website.

If you do not agree with these Terms, you should not use the website or place an order.


1. About Matchy

Matchy sells sealed matcha capsule products through its online store.

Our products are intended for customers in Bulgaria and Romania.

We sell to both:

  • individual consumers; and
  • businesses or companies.

If you purchase as a business customer, certain consumer protection rights, including the consumer right of withdrawal, may not apply.


2. Shopify

Our online store is powered by Shopify.

Shopify provides the ecommerce platform that allows us to display products, process orders, manage checkout, and operate our online store.

Any purchase you make through the website is made directly from Matchy LTD, not from Shopify. Shopify is not responsible for the products sold by Matchy, delivery, returns, refunds, product quality, or any dispute between you and Matchy.


3. Eligibility to Use the Website

By using the website or placing an order, you confirm that:

  • you are legally capable of entering into a contract;
  • the information you provide is accurate, complete, and up to date;
  • you are purchasing for lawful purposes;
  • you will not misuse the website or interfere with its operation.

The website and products are not intended for children.


4. Customer Accounts

At the moment, purchases are made through checkout only. Customer accounts are not required.

If we enable customer accounts in the future, you will be responsible for maintaining the confidentiality of your login details and for all activity under your account.


5. Products

We make reasonable efforts to display and describe our products accurately.

However, product images, packaging, colors, and visual presentation may differ slightly depending on your screen, device settings, production batches, packaging updates, or photography.

We reserve the right to:

  • update product descriptions;
  • change packaging;
  • discontinue products;
  • limit quantities;
  • refuse or cancel orders where necessary.

Product availability is not guaranteed until your order has been accepted and confirmed.


6. Capsule Compatibility

Matchy capsules are intended for use with compatible Nespresso Original Line machines.

They are not intended for Nespresso Vertuo machines or other incompatible capsule systems.

It is your responsibility to check whether your machine is compatible before placing an order.

Matchy is not affiliated with, endorsed by, sponsored by, or connected to Nespresso or Nestlé.
The name “Nespresso” is used only to indicate capsule compatibility. Nespresso and related marks are trademarks of their respective owners.


7. Product Information and Responsible Use

Our products are food/beverage products in capsule form.

Any product information on the website is provided for general informational and commercial purposes only. It should not be treated as medical, nutritional, or health advice.

You should read all product information, ingredients, labels, and usage instructions before consuming the product.

If you have allergies, medical conditions, are pregnant, sensitive to caffeine, or have specific dietary restrictions, you are responsible for checking whether the product is suitable for you before purchase or consumption.


8. Orders

When you place an order, you make an offer to purchase the selected products.

An order is accepted only after we confirm it by email, message, or order confirmation through the website.

We reserve the right to refuse, cancel, or limit an order where:

  • the product is unavailable;
  • the order information is incorrect or incomplete;
  • payment is not completed or confirmed;
  • the order appears fraudulent or suspicious;
  • the customer has repeatedly refused cash-on-delivery parcels;
  • there is an obvious pricing or product error;
  • we are unable to deliver to the provided address;
  • we are legally required to refuse the order.

If we cancel an order that has already been paid, we will refund the paid amount using the original payment method where possible.


9. Prices and VAT

Prices are displayed on the website in the currency shown at checkout.

At the date of these Terms, Matchy LTD is not registered for VAT. Therefore, VAT is not charged separately unless this changes in the future.

We reserve the right to update prices, discounts, promotions, and shipping fees at any time.

The price applicable to your order is the price displayed at checkout when you place your order.

If there is an obvious pricing error, we reserve the right to cancel the order and refund any amount already paid.


10. Payment Methods

We currently accept:

  • cash on delivery;
  • debit card payments;
  • credit card payments.

Card payments are processed through third-party payment providers. We do not directly store full card details.

For cash-on-delivery orders, payment is made to the courier upon delivery according to the courier’s payment process.


11. Cash on Delivery

If you choose cash on delivery, you agree to pay the full order amount to the courier when the parcel is delivered or collected.

If you refuse or fail to collect a cash-on-delivery parcel without a valid reason, the order may be cancelled.

If the same person repeatedly refuses, avoids, or fails to collect cash-on-delivery parcels, we reserve the right to refuse future cash-on-delivery orders from that person and require advance payment instead.


12. Delivery

We deliver through courier partners including Econt and Speedy.

Estimated delivery time is usually:

2–3 working days

Delivery times are estimates and may vary depending on courier workload, destination, holidays, weather, operational issues, or circumstances outside our control.

We are responsible for delivering the products to you in accordance with applicable consumer protection law.

For consumer orders, risk passes to you when the goods are delivered to you or to a person designated by you.


13. Delivery Issues

You are responsible for providing accurate delivery information, including:

  • full name;
  • phone number;
  • delivery address or courier office;
  • any other delivery details required.

We are not responsible for delays or failed delivery caused by incorrect, incomplete, or outdated information provided by you.

If a parcel is returned because you gave incorrect details, refused delivery, or did not collect the parcel, we may cancel the order.


14. Damaged, Broken, Wrong, or Missing Products

Please inspect your order immediately upon receipt.

If your product arrives damaged, broken, incomplete, or incorrect, contact us within 24 hours of receiving the order at:

Please include:

  • order number;
  • full name;
  • phone number;
  • description of the issue;
  • photos of the parcel, packaging, and damaged or incorrect products.

If we confirm that the product was damaged during shipping, broken, incorrect, or missing, we may offer:

  • replacement of the affected product;
  • sending a new box;
  • refund of the affected product;
  • another suitable solution agreed with you.

This section does not limit any mandatory consumer rights available under applicable law.


15. Right of Withdrawal for Consumers

If you are a consumer purchasing online in the European Union, you generally have the right to withdraw from the contract within 14 days from the day you, or a person designated by you, receive the goods, without giving a reason.

To exercise your right of withdrawal, you must inform us clearly before the 14-day period expires.

  • clear statement that you wish to withdraw from the purchase.

16. Return Conditions for Withdrawal

Because Matchy products are sealed food/beverage capsules, returned products must be:

  • unopened;
  • unused;
  • sealed;
  • undamaged;
  • in their original packaging;
  • suitable for resale.

Opened boxes, opened capsules, used products, damaged products caused by the customer, or products that are no longer suitable for resale cannot be returned simply because you changed your mind, unless required by mandatory law.

The right of withdrawal does not apply to sealed goods that are not suitable for return due to health protection or hygiene reasons if they have been unsealed after delivery.


17. Return Shipping for Withdrawal

If you exercise your legal right of withdrawal and the return is accepted, Matchy will cover the return shipping cost.

Returns must be sent back through the courier instructions we provide.

The return address will normally be the same courier office or courier return address from which the parcel was sent, such as an Econt or Speedy office, unless we provide different instructions.

Do not send products back without contacting us first.


18. Refunds

If you validly withdraw from the purchase and return the products in acceptable condition, we will refund the amount paid for the returned products.

Refunds will be made using the original payment method where possible.

For cash-on-delivery orders, we may request bank account details or another suitable payment method in order to process the refund.

We may withhold the refund until we have received the returned products or until you provide proof that they have been sent back.

Refund timing will comply with applicable consumer protection law.


19. Exchanges

For change-of-mind returns, we generally process refunds rather than exchanges.

For damaged, broken, wrong, or missing products, we may offer an exchange, replacement box, or refund depending on the situation.


20. Business Customers

If you purchase as a company, trader, or business customer, you confirm that the purchase is made for business purposes.

Consumer protection rights, including the 14-day consumer withdrawal right, may not apply to business purchases.

Any return, refund, or replacement for business customers will be handled according to these Terms, the specific agreement between us, and applicable law.


21. Promotions and Discounts

We may offer promotions, discounts, bundles, or limited-time offers.

Promotions may be subject to additional terms, expiry dates, product limitations, quantity limits, or geographic restrictions.

We reserve the right to modify, suspend, or cancel promotions at any time, unless this would violate applicable law or affect an already accepted order.


22. Reviews, Feedback, and User Content

If you submit a review, rating, testimonial, photo, comment, suggestion, or other content, you confirm that:

  • the content is true and based on your genuine experience;
  • you have the right to submit it;
  • it does not violate any law or third-party rights;
  • it is not offensive, misleading, defamatory, abusive, or unlawful.

By submitting content, you grant Matchy the right to use, display, reproduce, edit, publish, and share that content for website, marketing, advertising, and promotional purposes, without additional compensation, unless prohibited by law.

We may remove or refuse to publish content that we consider inappropriate, false, unlawful, offensive, or unrelated to our products.


23. Intellectual Property

All website content, including text, images, graphics, logos, product names, product descriptions, design elements, videos, photography, and other materials, belongs to Matchy or its licensors unless otherwise stated.

You may not copy, reproduce, distribute, modify, sell, exploit, or use our content for commercial purposes without our prior written consent.

The Matchy name, branding, product presentation, and visual identity may not be used without our permission.

You may not use the website:

We are not responsible for failure or delay caused by events outside our reasonable control, including:

  • technical failures;
  • supplier delays;

  • pandemics;
  • power or internet outages;
  • other events beyond our control.
